- EFTCO is the professional organization of Europe’s national tank cleaning associations.
- EFTCO’s objectives, laid down in the Memorandum of Association registered on 24 March 1999, are:
- to study, protect and develop its professional interests
- to develop and promote its professional image
- to seek and encourage the development of relationships with other organizations having related activities and with regulatory bodies both nationally and internationally.
- EFTCO’s organization is one of equality amongst members having equal rights and duties irrespective of political, cultural or religious aspects.
- EFTCO’s operations are subject to the legal provisions of the respective member countries on the European logistical territory.
- EFTCO’s pursuance to develop standards and documents will be subject to the legal rules of objectivity and fair competition within the European Community with the prime concern to make these operations transparent while adding value to the parties involved, to the environment and to the people employed.
- EFTCO considers the direct parties involved to be the bulk transporters in the supply chain of petrochemical, chemical and food products.
- EFTCO considers the indirect parties involved to be the producers, traders and institutions dealing with such products.
- EFTCO’s Council is aware of the diversity of regulations and business conduct in the European countries represented by their national associations and will pursue a common basis of understanding through commonly agreed policies and procedures such as EFTCO Codes of operations, SQAS Tank Cleaning, European Cleaning Document (ECD) a.o.
- EFTCO’s Council requires from its’ members that the understanding and the acceptance of this code of conduct is respected as gentlemen do. To achieve this goal the Council will have an agenda in anticipation of any meetings, will keep formal records of the minutes of meetings, will have a formal process for acceptance, or otherwise of the minutes. The Council will ensure that the resources are made available for the purposes of recordkeeping and for supervising the statutory provisions.
- EFTCO’s Council requires that only information in conformity with the competition law is exchanged and/or discussed and will consult with appropriate counsel on all questions related to competition law. For example the following issues are not allowed to be discussed in fact or appearance: prices, discounts, individual company data on costs, production, capacity, plans of individual companies, proposals for restricted territories or customers, rates and rate policies, company bids on contracts, matters relating to actual or potential individual suppliers or customers that might have the effect of excluding them from any market or influencing the business conduct of firms toward them, blacklist or boycott customers or competitors. The members are committed to deal on their national association’s level about any dispute in this respect. In the event these disputes need further arbitration this will be escalated on the level of the EFTCO Council on the initiative of the national association’s president.
